Mr Gitura, who is the Senate
Deputy Speaker, claims that Roy Maina Kiarie's petition is scandalous,
lacks merit, defective and an abuse of the court process since it does
not disclose any reasonable cause for action.
“The petitioner’s grievances do
not demonstrate in what manner I have violated his rights and freedoms.
The orders he is seeking are incapable of being granted as they grossly
contravene my own rights,” swears Mr Gitura.
MR GITURA
The senator is embroiled in the paternity row with Mr Kiarie who filed the suit seeking a declaration that Mr Gitura is his biological father.
Mr Kiarie also wants a
declaration that the senator’s refusal to acknowledge him as his son and
the denial to allow him use his name and access his property is
unconstitutional.
He claims that he was born out
of a relationship between Mr Gitura and his mother Rachael Njeri Kiarie
and grew up under the custody of her mother until she informed him that
Mr Gitura is his biological father.
